Salhan & Company Ltd defend clients facing road traffic prosecutions and representation in the defence of proceedings before the Magistrates Court and the Crown Court, throughout England and Wales.  We can provide representation either through the Legal Aid Scheme or on a private fee-paying basis.

We understand that the loss of a driving license can have a devastating effect upon an individual and their personal life, their employment, or their business.  Facing disqualification can cause an individual a lot of stress and can be a daunting prospect.  Therefore, it is vital to consider whether a road traffic prosecution has been correctly brought before the Courts and to assess all relevant lines of defence.

It is also important and relevant to recognise that many road traffic offences are viewed as serious and can result in a sentence of imprisonment being imposed. We deal with the full range of driving offences from speeding to death by dangerous driving.

MOTORING OFFENCES FEES

(Summary Only Offences i.e. matters which can only be dealt within the Magistrates Court)

GUILTY PLEA: (our legal fees)

  • £500 plus VAT
  • Non-local court (outside Black Country area) travel is £125 p/h plus VAT in addition to the above

Please note our fee includes attendance, preparation, considering the evidence, taking instructions, providing advice on likely sentence and attendance and representation at a single hearing at the Magistrates Court by an experienced qualified solicitor.

The key stages are:

  1. To meet with your solicitor to provide instructions on what happened as well as to explain Court procedure and sentencing options available to the Court
  2. We will consider initial disclosure and any other evidence and provide advice
  3. We cannot provide a timescale of when your hearing will take place as this is dependent on the Court listing for that day
  4. We will attend court on the day and meet with you before going into the hearing
  5. We anticipate being at court for half a day
  6. We will discuss the outcome with you. If advice is required on an appeal this will be given however any work undertaken i.e. lodging of an appeal and any representation at an appeal hearing will carry an additional cost as outlined below

The fee does not include the instruction of any expert witness cost if applicable which is subject to client agreement. We will discuss the outcome with you and if advice is required on an appeal this will be given as part of the fee however any work undertaken i.e. lodging of an appeal and any representation at an appeal hearing will carry an additional cost as outlined further below.

NOT GUILTY PLEA: (our legal fees)

  • Not Guilty Plea – £900 plus VAT for half day trial
  • Not Guilty Plea – £1200 plus VAT for full day trial (our legal fees per day)
  • Non-local Court (outside Black Country area) travel is £125 p/h plus VAT in addition to the above

Please note our fee includes attendance, preparation, considering the evidence, taking instructions this includes taking of witness statements, providing advice on likely sentence plus attendance and representation at trial by an experienced qualified solicitor.

  7. Time estimate for trials are difficult to estimate however we will give you an accurate as possible picture once we have considered all of the evidence.

We will discuss the outcome with you and if advice is required on an appeal this will be given as part of the fee however any work undertaken i.e. lodging of an appeal and any representation at an appeal hearing will carry an additional cost as outlined below.

APPEAL: (our legal fees)

  • Appeal against Conviction – £1500 plus VAT (including counsel’s fees) for one day hearing)
  • Appeal against Sentence to Crown Court – £1000 plus VAT (including counsel’s fees) for one day hearing

Please note our fee includes attendance, preparation, considering the evidence, taking instructions, providing advice on likely sentence, lodging an appeal and representation at Court.

N.B. Please note none of the above fees include expert’s fees which carries an additional cost if applicable dependent upon the expert, subject to client’s agreement.  

In unusual circumstances such as dealing with novel legal technicalities then our fees may be increased but this is subject to client’s agreement.
